FAA Rules for Real Estate Drone Photography


The pilot must hold a Remote Pilot Certificate issued by the FAA
The pilot must register their drone with the FAA
The drone must weigh less than 55 pounds
The pilot must fly in Class G airspace
The pilot must keep the drone within visual line-of-sight
The pilot must fly at or below 400 feet
The pilot must pass a recurrent aeronautical knowledge test at an FAA-approved testing center every 24 months.



Agents face an $11,000 FAA fine for using an unlicensed pilot


Because you are using aerial photos to sell a home, the drone has to comply with all commercial drone usage rules. These rules include the times of day when drones are allowed to fly, height, sightline, and airspace restrictions.

This is important because hiring an unlicensed drone pilot for commercial photography has resulted in massive fines for real estate agents. While operating a drone for commercial purposes without a license can result in FAA fines of $1,100 per occurrence, the agent who hires the pilot can and have faced penalties of $11,000 (10x) per violation.
